STUN Design and Interactive, LLC, doing business as The STUN Agency (“STUN,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, communicate with us, submit a contact form, pay an invoice, or receive a business communication from us.

For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, or can reasonably be associated with an individual.

1. Scope of This Privacy Policy

This Privacy Policy applies to:

  • The STUN Agency website and pages that link to this Privacy Policy.
  • Information submitted through our website contact forms.
  • Communications between you and STUN.
  • Our online invoice and payment process.
  • Business-to-business outreach communications sent by or on behalf of STUN.

This Privacy Policy does not govern personal information that STUN processes solely on behalf of a client while providing branding, creative, marketing, social media, social intelligence, website, or other professional services. That information is governed by the applicable client agreement, statement of work, data-processing terms, and applicable law.

This Privacy Policy also does not govern third-party websites, applications, or services that maintain their own privacy policies.

2. Personal Information We Collect

Information You Provide to Us

We may collect information that you provide through our website, by telephone, in person, or through other communications, including:

  • Business or organization name.
  • Job title or professional role.

  • Telephone number.
  • Information about a project, business need, or potential engagement.
  • The contents of messages and other communications you send to us.
  • Billing-contact and invoice information.

Our public website forms do not permit file uploads or drawn signatures.

Please do not submit payment-card information, Social Security numbers, government identification numbers, account passwords, health information, confidential client information, or other sensitive information through a general contact form or ordinary email.

Information Collected Automatically

When you visit our website, we and our website, analytics, hosting, security, and technical-service providers may automatically collect information such as:

  • Internet Protocol address.

  • Operating system.
  • General geographic area inferred from an Internet Protocol address.

  • Pages viewed or resources requested.
  • Dates and times of visits.

Contact-Form Information

When you submit a contact form, the information you provide is delivered to authorized members of STUN’s leadership and business-development teams through company-managed email accounts.

Contact-form submissions may also be stored in our website database. Access is limited to personnel and service providers who need the information to respond to your inquiry, evaluate a potential engagement, operate the website, or protect our systems.

Analytics Information

We use Google Analytics, implemented through MonsterInsights, to understand how visitors find and use our website and to evaluate its content, performance, and usability.

Google Analytics may collect information such as:

  • Approximate geographic area.
  • Referring sources.
  • Pages viewed.
  • Dates and times of visits.

Our Google Analytics configuration is not intended to collect contact-form contents, payment-card information, or other sensitive information.

We do not use Google Analytics for remarketing or targeted advertising.

Analytics information is retained according to the settings maintained in our Google Analytics account and Google’s applicable retention practices.

Invoice and Payment Information

Our invoice portal retrieves invoice information from Paymo.

When you enter payment-card information, that information is received transiently by STUN’s application and submitted to Authorize.Net through a direct application programming interface connection for authorization and processing.

STUN does not intentionally store full payment-card numbers or card security codes. The application receives this information transiently so that it can submit the transaction to Authorize.Net.

We may receive and retain other transaction-related information, including:

  • Payer name.
  • Business name.
  • Billing-contact information.
  • Billing address.
  • Invoice number.
  • Payment amount.
  • Transaction date.
  • Payment status.
  • Transaction or authorization identifier.
  • Authorization or decline result.
  • Masked payment-card information.

We use this information to process and reconcile payments, respond to payment questions, prevent fraud, manage disputes and chargebacks, maintain accounting records, and comply with legal obligations.

Do not send payment-card information through a general contact form or ordinary email.

Business Contact and Outreach Information

STUN occasionally uses Apollo or similar business-communication tools to conduct relevant business-to-business outreach.

In connection with that outreach, we may process:

  • Professional contact information.
  • Company name.
  • Job title or professional role.
  • Business email address.
  • Business telephone number.
  • Publicly available professional information.
  • Email-delivery status.
  • Whether an email was opened.
  • Whether a link in an email was clicked.
  • Responses to our communications.
  • Unsubscribe and opt-out preferences.

Apollo outreach information is not currently linked to our website analytics for remarketing or targeted advertising.

3. Sources of Personal Information

We may receive personal information:

  • From our website, hosting, analytics, security, email, and technical-service providers.
  • From Paymo and Authorize.Net in connection with invoices and payments.

  • From social-media platforms when you interact with STUN or our content through those platforms.

Google reCAPTCHA

We use Google reCAPTCHA to help protect our website forms from spam, fraud, and automated abuse.

When reCAPTCHA is used, Google may process technical information such as your Internet Protocol address, browser information, device information, cookies, and interactions with the website or reCAPTCHA service.

Google’s handling of that information is governed by Google’s own privacy policy and terms.

Instagram and Social-Media Content

We use an Instagram-feed service to display social-media content on our website.

When content or media is retrieved from Instagram, Meta, or another third-party server, that party may receive technical information such as:

  • Your Internet Protocol address.
  • Browser or device information.
  • The website page requesting the content.
  • Cookie or account information available to that third party.

Instagram and Meta process information under their own privacy policies. STUN does not control their independent processing.

Following a link to Instagram or interacting with Instagram content may result in additional information being collected directly by Meta.

6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients.

Authorized STUN Personnel

We disclose information internally to personnel who need it to respond to an inquiry, evaluate a project, provide services, manage a payment, maintain business records, or operate and protect our systems.

Website, Hosting, Email, and Security Providers

We use service providers that help us host, maintain, secure, back up, monitor, and operate our website and deliver website-generated email.

These providers may process technical information, security logs, contact-form information, or other information necessary to perform their services.

Analytics and Technology Providers

We may disclose website-interaction and technical information to providers such as Google in connection with Google Analytics and reCAPTCHA.

Social-Media Providers

Instagram, Meta, and related content-delivery services may receive technical information when social-media content is displayed or accessed.

Invoice and Payment Providers

We disclose information to Paymo, Authorize.Net, financial institutions, acquiring banks, issuing banks, payment networks, fraud-prevention providers, and related service providers as necessary to retrieve invoices, authorize and process transactions, prevent fraud, resolve payment issues, and maintain transaction records.

Business-Communication Providers

We may disclose professional contact information and email-engagement information to Apollo or similar providers that help us deliver and manage business-to-business communications.

Professional Advisers and Authorities

We may disclose information to attorneys, accountants, auditors, insurers, consultants, law-enforcement authorities, courts, regulators, and other appropriate parties when reasonably necessary to:

  • Comply with applicable law or legal process.
  • Protect our legal rights, safety, systems, or property.
  • Investigate suspected fraud, abuse, or illegal activity.
  • Establish, exercise, or defend legal claims.
  • Protect the rights or safety of another person.

Business Transactions

We may disclose information in connection with an actual or proposed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

Any recipient would be required to handle personal information in accordance with applicable law.

7. Sale and Targeted Advertising

STUN does not sell personal information for monetary consideration.

STUN does not use personal information collected through the website for targeted advertising, cross-context behavioral advertising, or remarketing.

Certain third-party providers may process information under their own privacy policies when their services or content are loaded. STUN does not control all independent processing performed by those third parties.

8. Retention

Our general retention target for website inquiries and related business communications is approximately two years after the last relevant interaction.

Actual retention may vary when a longer period is reasonably necessary for:

  • An active or prospective business relationship.
  • Contract administration.
  • Payment processing and reconciliation.
  • Tax, accounting, or insurance obligations.
  • Security and fraud prevention.
  • Dispute resolution.
  • Chargebacks or payment inquiries.
  • Establishing, exercising, or defending legal claims.
  • Compliance with legal or regulatory requirements.
  • Maintaining an unsubscribe or privacy-request suppression record.

Payment and transaction records may be retained for longer periods when required for accounting, tax, banking, payment-card, dispute-resolution, or legal purposes.

When information is no longer reasonably necessary, we may delete it, deidentify it, or securely dispose of it, subject to legal requirements and technical limitations.

Archived and Backup Information

Personal information may remain in archived or backup systems after it has been removed from active systems.

Backups are maintained for business continuity, disaster recovery, system integrity, and security. They are not ordinarily accessed or used for routine business purposes.

Backup copies are deleted or overwritten according to our normal backup lifecycle. We do not promise immediate deletion from every archived or backup copy, and it may not be reasonably practical to isolate and delete an individual record from a backup.

If a backup containing information covered by a valid deletion request is restored or returned to active use, we will take reasonable steps to reapply the deletion or restrict further use of the information, subject to applicable law.

9. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These safeguards may include:

  • Access controls.
  • Account-security measures.
  • Website-security and firewall tools.
  • Software maintenance and updates.
  • Security monitoring.
  • Backups.
  • Restrictions on access to contact-form and transaction information.
  • Use of payment and technology service providers.

No website, email system, payment system, network, or method of electronic transmission or storage is completely secure. We therefore cannot guarantee absolute security.

10. Business Email Choices

STUN may send relevant business-to-business communications to professional contacts. Our email-delivery provider may report whether a message was delivered, opened, or clicked.

You may stop receiving promotional or business-development communications by:

  • Using the unsubscribe option included in the communication.
  • Replying to the communication with an unsubscribe request.
  • Contacting us through our Contact page.

We may retain a minimal suppression record, such as an email address or another identifier, after an opt-out so that we can honor the request and avoid sending further promotional communications.

Opting out of promotional communications will not prevent STUN from sending non-promotional communications concerning an active project, invoice, payment, transaction, contract, request, or existing business relationship.

11. Your Privacy Rights

Depending on where you live and the law that applies, you may have the right to:

  • Confirm whether we process your personal information.
  • Request access to personal information we maintain about you.
  • Request correction of inaccurate personal information.
  • Request deletion of personal information.
  • Request a portable copy of certain personal information.
  • Opt out of the sale of personal information.
  • Opt out of targeted advertising.
  • Opt out of certain profiling activities.
  • Appeal a decision concerning a privacy request.
  • Exercise your privacy rights without unlawful discrimination.

STUN does not currently sell personal information for monetary consideration or use website information for targeted advertising.

Please do not submit payment-card information, passwords, Social Security numbers, or unnecessary sensitive information as part of a privacy request.

Verification

We may take reasonable steps to verify your identity before completing a request. Verification may include:

  • Confirming control of an email address.
  • Asking for information concerning your prior interaction with STUN.
  • Requesting other information reasonably necessary to authenticate the request.

Information collected for verification will be used only to evaluate, process, and document the request.

Authorized Agents

An authorized agent may submit a request on your behalf where permitted by law.

We may request proof of the agent’s authority and may independently verify the identity of the person whose information is involved.

Limitations and Exceptions

Some information may be exempt from a request or may need to be retained to:

Appeals

To appeal a decision concerning a privacy request, use the same submission method and place the words “Privacy Appeal” at the beginning of your message. Explain the decision you are appealing and the reason you believe it should be reconsidered.

12. Do Not Track and Opt-Out Preference Signals

Some browsers offer a “Do Not Track” setting. Because there is not a consistent industry standard governing these signals, our website is not currently configured to respond to all Do Not Track signals.

Where applicable law requires us to recognize a legally valid opt-out preference signal, we will process that signal as required for activities to which the signal applies.

Because STUN does not sell personal information for monetary consideration or use website information for targeted advertising, an opt-out preference signal may not change your website experience.

13. Children’s Privacy

Our website and services are intended for businesses and adults. They are not directed to children under 13.

We do not knowingly collect personal information from children under 13 through our website.

A parent or legal guardian who believes that a child has submitted personal information may contact us to request its deletion.

STUN is based in the United States, and information covered by this Privacy Policy may be processed and stored in the United States.

Privacy and data-protection laws in the United States may differ from those in your country, state, or jurisdiction.

16. Changes to This Privacy Policy

We may update this Privacy Policy as our website, business practices, service providers, or legal obligations change.

When we make changes, we will update the “Last Updated” date at the top of the Privacy Policy. When appropriate, we may provide additional notice of material changes.
